Exchange rules
1. General Provisions
This Agreement (hereinafter referred to as the Agreement) describes the rules and conditions on the basis of which the services of Bit-Exchanger exchange service are provided and is an official written public offer addressed to individuals and legal entities (hereinafter referred to as the User) to conclude the Agreement on the provision of services by Bit-Exchanger service on the terms and conditions set forth below.
Before using the services of Bit-Exchanger, the User is obliged to familiarize himself/herself with the terms and conditions of the "Agreement on the provision of services by Bit-Exchanger".
The use of Bit-Exchanger services is possible only if the User accepts all the terms and conditions of the Agreement.
The current version of the Agreement is publicly available on the website of the Bit-Exchanger service.
2. Terms and definitions used in the Agreement
Bit-Exchanger Service (Service) - a system of Internet services for exchange, sale and purchase of electronic currencies.
Internet site of the Service - bit-exchanger.me
User - any individual or legal entity that uses the services of the Bit-Exchanger Service and has accepted the Agreement in accordance with its terms.
Partner - a person who provides the Service with services to attract Users, the terms and conditions of which are described in this Agreement.
Payment system - a software product created by a third party, which is a mechanism for realization of accounting of money (electronic money) and/or other obligations, payment for goods and services in the Internet, as well as organization of mutual settlements between Users.
The main payment systems under this Agreement are:
Bitcoin, AdvCash, and others. The exact list of payment systems is specified on the website of the Service.
Client of the payment system - a person who has entered into an agreement with the relevant payment system to acquire property rights of claim to it, measured in conventional units accepted in the relevant payment system.
Electronic currency - a monetary and/or other obligation between the developer of this currency and its user, expressed digitally.
Payment/Operation - transfer of electronic and/or other currency from the payer to the recipient.
Application - expression of the User's intention to use one of the services offered by the Bit-Exchanger Service by filling out an electronic form through the Service's website, on the terms and conditions described in the Agreement and specified in the parameters of this Application.
Card verification is a check of card (or account) belonging to its owner. Conditions of verification of belonging are set by the Service, it is made one time for each new account (card) of the client.
Source currency - electronic currency, which the User wishes to sell or exchange.
Source account - wallet number or any other designation of the User's account in the Payment system, from which the Source currency was sent.
Received currency - electronic currency, which the User receives as a result of selling or exchanging the Source currency.
Recipient's Account - wallet number or any other designation of the User's account in the Payment system to which the Received currency will be sent.
Currency Reserve - the amount of certain Electronic Currency available in the Bit-Exchanger Service at the moment of creating the Order.
Currency Exchange - exchange of electronic currency of one payment system for electronic currency of another payment system.
Exchange Rate - the value ratio of two electronic currencies at their exchange.
Electronic Currency Reserves - amounts of Electronic Currencies or funds available to the Service for the performance of services. The amounts of reserves are indicated on the Service's website on the main page.
3. Subject of the Agreement and the procedure for its entry into force
3.1 The subject of this Agreement is the provision of the following services to the User by the Bit-Exchanger Service:
3.1.1. exchange of electronic currency;
3.1.2. selling electronic currency to the User;
3.1.3. purchase of digital currency from the User.
3.2 Acceptance (acceptance of the terms and conditions) of this Agreement (Offer) is made by the User in case of:
3.2.1. Sending an Application for one of the services offered by the Service;
3.2.2. Registration on the Internet site of the Service.
3.3 When sending an Application, the acceptance of the public offer is recognized as the User's actions upon completion of the Application, confirming his/her intention to make a transaction with the Service on the terms offered by the Service. The date and time of acceptance, as well as the parameters of the conditions of the Application are recorded by the Service automatically at the moment of completing the formation of the Application. This Agreement enters into force at the moment of receipt of electronic currency or money in the amount provided for by the parameters of the Order from the User to the Service's requisites.
3.4 In case of registration on the Internet site of the Service, this Agreement comes into effect at the moment of ticking the box before the words "I agree with the terms of the offer" and clicking the button "Register".
3.5 The term of validity of the agreement is established indefinitely until the moment of termination of the agreement on the initiative of one of the parties on the conditions specified below.
3.5.1 Information about applications, the last status of which has not changed for 12 months - is automatically deleted from the Service. Regardless of the final status.
4. Services and the procedure for their provision
4.1 General order of rendering services by the Service
4.1.1 Ordering of services of the Bit-Exchanger Service is carried out by the User by sending an Application through the Internet site of the Service.
4.1.2 Management of the exchange process or obtaining information about the progress of the service by the User is performed using the appropriate user interface located on the website of the Service.
4.1.3. The Bit-Exchanger Service executes Applications on an irrevocable basis in accordance with the terms and conditions of the relevant Payment Systems. Special conditions of work with some Payment Systems are specified below.
4.1.4 Bit-Exchanger Service is not responsible for the actions of the Payment system to its Client. The rights and obligations of the payment system and its Client are regulated by the terms of service of the respective Payment Systems.
4.1.5 By using the services of the Bit-Exchanger Service, the User confirms that he/she legally owns and disposes of the funds and electronic currency involved in the respective Payment.
4.1.6. The User undertakes to independently calculate and pay all taxes required by the tax legislation of the User's location.
4.2 Electronic Currency Exchange Service
4.2.1 By placing an Order, the User authorizes, and the Bit-Exchanger Service, on its own behalf and at the expense of the User, performs actions to exchange the Electronic Currency of one Payment System (Source Currency) for the Electronic Currency of another Payment System (Received Currency) selected by the User.
4.2.2 The User undertakes to transfer (transfer) the Source Currency, in the amount specified in the Application, and the Bit-Exchanger Service, after receiving the corresponding Electronic Currency, undertakes to transfer (transfer) to the User the Received Currency, calculated at the Exchange Rate and in accordance with the tariffs of the Service.
4.2.3 The amount of the Bit-Exchanger Service Fee is reflected in the Application and confirmed by the User on one of the pages of the user interface when making an Application.
4.2.4 The obligation of the Bit-Exchanger Service to transfer (transfer) the Electronic Currency to the User is considered to be fulfilled at the moment when the Electronic Currency is debited from the account of the Bit-Exchanger Service in the corresponding Payment System, which is registered in the transaction history of the corresponding Payment System.
4.3 The service of selling Electronic Currency to the User
4.3.1 By placing an Order, the User authorizes, and the Bit-Exchanger Service, on its own behalf and at the expense of the User, performs actions on the purchase and transfer of Electronic Currency to the User.
4.3.2 The amount of remuneration of the Bit-Exchanger Service for the specified actions is reflected in the Application and confirmed by the User on one of the pages of the user interface.
4.3.3 Within 24 hours of receiving funds from the User in the amount specified in the respective Application, the Bit-Exchanger Service is obliged to transfer (transfer) the received Electronic Currency to the details and in the amount specified by the User in the Application. Except for cases related to the technical work of wallets, exchanges and banks, the activity of which cannot be influenced by the Service.
4.3.4 The Bit-Exchanger Service has the right to cancel the User's application for the purchase of Electronic Currency, if the payment for such an application has not been received on the settlement account of the service after 24 hours from the moment of creating such an application.
4.3.5 The obligation of the Bit-Exchanger Service to transfer (transfer) the received currency to the User is considered to be fulfilled at the moment when the Electronic Currency is debited from the account of the Bit-Exchanger Service in the respective Payment System, which is registered in the transaction history of the respective Payment System.
4.4 The service of purchasing e-currency from the User
4.4.1 By submitting an Application, the User orders, and the Bit-Exchanger Service, on its own behalf and at the expense of the User, buys digital currency from the User, as well as performs actions to transfer the cash equivalent to the User in the amount specified in the Application.
4.4.2 Within 24 (Twenty-four) hours from the moment of receiving the Initial Currency from the User, in the amount specified in the relevant Application, the Bit-Exchanger Service is obliged to transfer the cash equivalent of the transferred Electronic Currency to the User, in the manner selected by the User when submitting the Application. Except for cases related to the technical work of wallets, exchanges and banks, the activity of which cannot be influenced by the Service.
4.4.3 The amount of remuneration of Bit-Exchanger Service for the specified actions is reflected in the Application and confirmed by the User on one of the pages of the user interface.
4.4.4 The obligation of the Bit-Exchanger Service to transfer the cash equivalent of the transferred E-currency is considered to be fulfilled at the moment when the corresponding amount is debited from the account of the Bit-Exchanger Service.
4.4.4.1 Please note that if the use of automation tools is detected - the order may be blocked by the security system, and in this case only a refund will be made. The security system works to detect "trading bots", "arbitrage bots", and if such activity is detected in your orders - unfortunately, they will be canceled automatically.
4.4.4.2 The service provides clients with flexible exchange conditions to choose from. For a fixed tariff, the exchange office has the right to charge an additional commission. This commission is obligatorily displayed to the user BEFORE creating a request, where he chooses the mode himself. In this case, the application is processed by the robot, individually, in the shortest possible time. Processing period - is always displayed when creating a request, and the client chooses it himself.
4.4.4.3 Selecting the tariff "Non-fixed rate" means that the website displays the last, maximum available tariff for the exchange. Since in this case - all expenses for the commission of the exchange order, the commission of the automated system of sending, the exchanger takes on himself - the rate is fixed by placing the market order on exchanges and services of partners. The final amount to receive will be updated - after the order is executed. The cryptocurrency market is volatile, so the total amount may change both up and down.
4.4.5. AML/KYC:

- KYCC - Know Your Customer's Customer
4.4.6 Basic AML/KYC requirements:
- Internal verification system for high-risk transactions, performs verification based on Crystal, to prevent freezing of funds and proceedings with cryptocurrency exchanges.
- In case of a high-risk transaction request from an exchange, the exchange will suspend the exchange transaction until the customer provides proper confirmation of the origin of the funds to the satisfaction of the AML/KYC division of the exchange.
- The confirming factors include: documents of the transaction, the consequence of which the client confirms the legal possession of cryptocurrency assets. Identity documents (passport or driver's license).
- When conducting a cryptocurrency transaction with Business - accounts, the supporting documents are: registration documents with the specified legal address, as well as the registration code of the company, bank account/exchange statement, confirming the legal possession of cryptocurrency assets.
- In case the transaction is blocked by the exchange - it can be blocked for the period set by the regulator. Each situation is individual and may take from 1-3 business days, in complicated cases - until the end of legal proceedings, or the arrest of other wallets associated with the cryptocurrency address.
4.4.7. It is forbidden to deposit and withdraw from any Russian platforms (CommEx, Garantex, Rapira, Garantex, Bitpapa, NetEx24, Tornado Cash, Hydra) and others under sanctions.
5. Additional Terms of Service.
5.1 If the User does not receive the Electronic Currency or funds from the Bit-Exchanger Service within 24 hours from the moment of making the Application, the Service has the right to cancel such Application in case of manual processing of received payments, and within 1 hour in case of automatic processing. If within 30 days the Order is in the status "Canceled" it is automatically deleted. When making a refund, all commission expenses for the transfer are made from the received funds at the User's expense.
5.2 In case of receipt from the User to the Bit-Exchanger Service of Electronic Currency or funds in the amount that differs from the amount specified in the Application, the Service has the right to consider it as an order of the User to recalculate the application according to the actually received amount of Electronic Currency. In case the exchange rate changes by 3% or more, the Service has the right to recalculate the exchange rate to the current one. In case the amount of the received Electronic Currency or funds differs from the amount declared by the User by more than 10%, the Service can unilaterally cancel the Order and return the received funds to the payer's details. When making a refund, all commission expenses for the transfer of funds are made from the received funds at the expense of the User.
5.3 If the Bit-Exchanger Service fails to fulfill the condition of sending the E-currency or funds under the Application to the details specified by the User within 24 hours from the moment of sending the Application, the User has the right to demand the return of the E-currency or funds in full, except for the cases specified in this Agreement. The request for the return of the E-currency or funds can be fulfilled by the Service only if at the moment of receiving such a request the cash equivalent has not been sent to the details specified by the User. The extension of the period of transfer of the Electronic currency or funds may be caused by the terms of processing of applications of individual Payment systems, in which case the Service is not responsible and no refund is made.
5.4 The System fixes the exchange rate of the Electronic Currency for no more than 18 minutes from the moment the Order is made. If the User pays after 18 minutes, the System automatically updates the exchange rate and blocks the possibility to create an Order. In case of blocking the creation of a request it is necessary to create a new request at the current rate, skipping the point with payment, as well as contact the technical support of the Bit-Exchanger Service.
In case of Bank payments, the rate is always updated.
5.5 Special conditions of some Payment Systems:
- Bank payments are processed by the Service within 24 hours, if necessary the Service may require Verification of the client's card(account);
- If the Bitcoin Application is completed, no refund is possible;
- If the sent Bitcoin amount is less than 0.0010 VTS, the money will not be returned
- Bank transfers to Visa/Mastercard UAH are credited instantly in most cases, but in some cases it may take up to 5 banking days.

5.6 Special conditions of work with cryptocurrency wallets:
-The user is independently responsible for the correctness of entering e-wallets.
-Exchange office pays out e-currency exclusively to the wallet specified in the client's application.
-In the exceptional case of replacing the wallet, it is not possible to send to it. In this case, the user from the mail specified in the application, can contact the administration to solve this issue and replace the wallet to active.
- If at the transfer "Bank to Any Direction" you indicated a comment to the payment not as in the description of the exchange, we have the right to impose a fine of 10% of the credited amount or make a refund with a commission of 10%.
6. Cost of services
6.1 The cost of services of the Bit-Exchanger Service is set by the management of the Service and published on the website of the Service.
6.2 The Bit-Exchanger Service has the right to unilaterally change the rates of exchange of Electronic currencies and charged commissions at any time, and notifies the Users of the Service about it by preliminary placement of information about these changes on the Internet site of the Service.
6.3 The Application created by the User on the Internet site of the Service specifies the Exchange Rate, the amount of commission charged by the respective Payment System for the Transaction, the amount of the Service's remuneration, the method of Exchange, as well as the total amount of transferred funds or e-currency.
6.4 The Bit-Exchanger Service charges the cost of its remuneration at the moment of the corresponding Transaction.
6.5 The Service offers the following reward system (only for registered Users). Find out the status of your discount, and increase your reward percentage by contacting technical support!
6.6 When exchanging "Cash" for "Cryptocurrency" - the rate is fixed for 18 minutes, if the transaction is conducted at our office. If, after creating a request - you did not come and did not deposit cash within 18 minutes, the request goes to the status of "Canceled", and after depositing cash - the rate is updated to the current one, taken from the exchange Binance. In the directions "Cash" - "Any direction" (except cryptocurrencies), the rate is fixed for the whole working day.
6.7 When exchanging to PrivatBank cards "card for payments" - the exchange office does not cover the bank's commission of 0.5%, as it is charged by the recipient's bank.
7. Affiliate program

8. Liability of the Parties
8.1 The Bit-Exchanger Service is liable to the User in the amount not exceeding the amount of Electronic Currency or money transferred by the User.
8.2 The Bit-Exchanger Service is not responsible for malfunctions, errors and failures in the operation of software and/or hardware that ensure the functioning of the Bit-Exchanger Service services, which occurred for reasons beyond the control of the Bit-Exchanger Service, as well as related losses of the User.
8.3 The Bit-Exchanger Service provides services only for the exchange, purchase and sale of Electronic Currencies. Bit-Exchanger in no way accepts payment in favor of any third parties, as well as prohibits transfers to wallets that do not belong to the User. Bit-Exchanger does not enter into any partnership relations, does not conclude any agreements with recipients of payments for its goods or services.
8.4 Bit-Exchanger Service is not responsible for the User's losses resulting from unauthorized actions of third parties.
8.5. The User bears full responsibility for the accuracy of the information provided by him/her when filling out the Application. If the User did not specify or incorrectly specified personal data or payment data, the Bit-Exchanger Service is not responsible for the User's losses incurred as a result of the mistake.
8.5.1 The service reserves the right to request the verification of conformity of payment data from the client, in case of suspicion of fraud. In cases when the client refuses - the funds are not returned and remain frozen until the sending is confirmed by the cardholder.
8.5.2 For the returns provided by the service policy - a commission of 5% of the received client's asset (bank transfers, cryptocurrencies, electronic currencies) is withheld.
8.6 The User guarantees that he/she is not involved in:
- money laundering operations;
- receiving proceeds from illegal drug trafficking;
- receiving proceeds from criminal and/or terrorist activities;
- income from trade with countries with which trade is prohibited by international organizations;
- proceeds from any other illegal activity.
8.7 In case of delayed receipt or non-receipt of funds to the details specified by the User, due to the fault of the Payment system or bank specified by the User in the Application, the Service does not bear any responsibility for possible damage caused to the User. The User agrees that in this case any claims are brought by him to the Payment system or bank, and the Service, in its turn, provides assistance to the User within the limits of its possibilities.
8.8 In case of detection of falsification of communication flows or any negative impact on the normal operation of the Service's program code, which is directly or indirectly related to the User's Application, the execution of the Application by the Service is suspended, and the recalculation of the parameters of the Application in accordance with the current terms and conditions or, in case of the User's disagreement with the recalculation, the return of the Electronic currency or funds to the payer's details is made for the funds already received.
8.9 The Parties shall be released from liability for full or partial non-fulfillment of their obligations under the Agreement, if such failure was caused by force majeure circumstances, which occurred after the Agreement came into force, as a result of extraordinary events that could not have been foreseen and prevented by reasonable measures.
9. Other terms and conditions
9.1 It is prohibited to use the Bit-Exchanger Service for fraudulent and illegal transactions.
9.2 Administration of the Bit-Exchanger Service reserves the right to provide information about payments to law enforcement and other authorities in accordance with the laws.
9.3 Upon request of the Administration of the Service, the User undertakes to provide identity documents, as well as other information related to payments.
9.4 The User undertakes not to disrupt the Bit-Exchanger Service by interfering with its software or hardware, as well as by distorting the parameters transmitted to the Service.
9.5 Bit-Exchanger Service in case of suspicious actions in the process of registration of an application by the User, in order to avoid damage from hacker attacks has the right to suspend the execution of such operations until the reasons for these actions are clarified.
9.6 The Bit-Exchanger Service has the right to refuse to execute the operation of exchange, purchase and sale of electronic currencies, if the transfer of the Electronic Currency to the Service account was made without making an Application using the user interfaces on the Service's website.
The e-currency transferred to the respective Service Accounts without making an Application through the user interfaces on the Service Website can be returned to the User upon request, taking into account the deduction of the payment system commission.
9.7 The Administration of the Service has the absolute right to refuse to provide services to any client without giving any reasons.
9.8 Service Rules prohibit sending money using self-service terminals. Otherwise, the administration reserves the right to request a check of the payer for the compliance of payment data and identity documents to prevent fraudulent actions of third parties.
9.9 In case of suspicion of fraud, the exchange office reserves the right to request a second check on the compliance of payment data and identity documents of the payer by video call. In such exceptional cases, it will be necessary to confirm your identity by video call, by providing an identification document and the card from which the payment was made.
10. Final provisions
10.1 The Parties have concluded this Agreement in electronic form and recognize it as equal in legal force to the agreement concluded in writing.
10.2. Bit-Exchanger Service has the right to unilaterally make changes to the Agreement by publishing changes on the System's website. The changes come into force from the moment of publication.
